C. 90 Changes in Penalties for Learner's Permit and Junior Operator License (JOL) Violations




Junior Operator Passenger Restriction/Penalties

No passengers during the first 6 months of
licensure, other than immediate family member,
unless accompanied by a person at least 21 years                     Previous restriction, increased penalties
old, has at least 1 year driving experience, hold's
a valid driver's license and is in the front
passenger seat.


1st offense: 60 day license suspension                                        Previously 30 day suspension

2nd offense: 180 day license suspension                                     Previously 60 day suspension
and required attitudinal retraining
        
Susbsequent offense: 1 year license                                            Previously 90 day suspension
suspension and required attitudinal
retraining




Junior Operator Night Driving Restriction/Penalties

Restrictions driving from 12:30am-5:00am
for duration junior operator licensure, unless                          Previous restriction begins at
accompanied by parent/gaurdian.                                                12:00am
Primary enforcement 1:00am-4:00am.

1st offense: 60 day license suspension                                        New Penalty

2nd offense: 180 day license suspension                                     New Penalty
and required attitudinal tretraining

Subsequent offenses: 1 year license suspension                       New Penalty
and required attitudinal retraining

Fine for unlicensed operation: $100 to $1000                            Previously between $100 and $200




Learners Permit Driving Unaccompanied Restrictions/Penalties

Restricts driving under a permit unless accompanied by
parent/guardian who is a valid driver's license and at               Previous law, new penalty
least 1 year driving experience.

1st offense: 60 day permit suspension                                         New Penalty

2n offense: 180 day permit suspension and completion            New Penalty
of driver attitudinal retraining

Subsequent offenses: 1 year permit suspension                        New Penalty

Fine for unlicensed operation: $100 to $1000                             New Penalty




Learners Permit Night Driving Restrictions/Penalties

If under 18, restricts driving between 12:00am -5:00am,           Previous law, new penalties
unless accompanied by parent/gaurdian who is a validly
licensed operator with at least 1 year driving experience.

1st offense: 60 day permit suspension                                          New Penalty

2nd offense: 180 day permit suspension and completion           New Penalty
of driver attitudinal retraining

Subsequent offenses: 1 year permit suspension                         New Penalty

Fine for unlicensed operation: $100 to $1000                              New Penatly




Driving Negligently or Recklessly as a Junior Operator

Increases the minimum 1st offense license suspension           Previously up to 60 day revocation
for junior operators who drive neglitgently or recklessly        upon conviction
to 180 days.

Subsequent conviction within 3 years: 1 year suspension       Previously up to one year suspension




Junior Operator and Learner's Permit Drag Racing Penalty

1st offense: 1 year license or learner's permit                         Previously 30 day suspension and fine
suspension and $250 fine and $500 license or                          between $100 and $500
learner's permit reinstatement fee                                           

2nd or subsequent offense: 3 year licenser's permit              Previously 30 day suspension and fine
suspension and $500 fine and $1000 license or                       between $200 and $1000 with a 3rd offense
learner's permit reinstatement fee                                           penalty of 1 year suspension and fine
                                                                                                      between $200 and$1000

Requires completion of SCARR program, driver                    New Penalty
attitudinal retraining course, and 2nd road test
for license reinstatement for JOL offenders

Operating a Motor Vehicle without having been issued a license

Increases maximum fine for operating a motor                     Previously between $100 and $200
vehicle without being duly licensed to $1000





Learners Permit Speeding/Penalties

1st offense: 90 day permit suspension,                                   Previous penalty is a fine
minimum $50 fine, plus additional $10
for each mph in excess of 10 mph over
posted speed limit, plus $50 surcharge

2nd or subseqent offense: 1 year permit                                Previous law for 3rd or subsequent
suspesion, minimum $50 fine, plus additional                     offense within a 12 month period is
$10 for each mph in excess of 10 mph over                            30 day permit suspension and fine
posted speed limit, plus $50 surcharge




Drag Racing Technical Change

Strikes penalties from C. 90, section 20 and establishes them in C. 90, section 17




Junior Operator Speeding/Penalties

1st offense: 90 day license suspension, $50 fine,                Previous penalty is a fine
plus additional $10 fine for each mph exceeding
10 mph over speed limit,  plus $50 sucharge,
completion of SCARR program and completion
of an attitudinal retraining course

2nd and subsequent offenses: 1 year license                       Previous penalty is 180 day license
suspension, $50 fine, plus additional $10 fine                     suspension and fine
for each mph exceeding 10 mph over speed limit,
plus $50 surcharge, completion of SCARR
program and completion of an attitudinal
retraining course

Requires $500 reinstatement fee and 2nd road                   Previously $100 reinstatement fee
test for license reinstatement
